The Driving Licence Question
AS A NATIONAL OF AN EEC COUNTRY LIVING IN HERE IN SPAIN, CAN I DRIVE WITH MY ORIGINAL LICENCE ISSUED FROM MY COUNTRY OF ORIGIN ?
Yes and No   Not again , you say! So let´s see if we can clarify the situation or really set the cat amongst the pigeons!
No, according to:
Information given on the Spanish Ministry of Interior website which
states that, if you establish residence in Spain, you have six month in
which to inform Trafico of your current address. This is known as
an  Annotación , which is when your Spanish address and personal
details are recorded on your current Memberstate driving licence. It
also states that at any moment you may change your current licence
issued by another member state for a Spanish Licence.
Yes, according to:
The Sentence passed by the Tribunual of Justice of the Comminuties of
Europe on 9th September, 2004, article C-195/02, which states that if
you are a national of an EEC State and reside in Spain for
more than six months and/or have a residencia, you do not have to
change your current driving licence to a Spanish one; neither do you
have to have an  Annotación .
According to this ruling therefore, the Spanish Traffic
Authorities should no longer be fining non-Spanish nationals from other
EEC Member States who have a valid driving licence, for not having
either
ˇ an  Annotación OR
ˇ A Spanish Licence.
Unfortunately, this is not the case and people are still being fined.
What can we do then?
After consultation with the British Consulate in Malaga, they have
informed me that they are now issuing to British nationals, a copy (in
Spanish) of the sentence passed on 9th September, 2004. *This is to
show to any Trafico officals in the event of being stopped, but
is no guarantee that you will not be fined.
However, aside from the contradictions, it is worth considering
an annotation on your current licence. This would enable Trafico to
contact your Spanish home address in the case of any emergency or
eventuality.
